As many of you will know, last July, in a historic verdict, the B.C. Supreme Court ruled in favour of the Office of the Privacy Commissioner and IndigiNews against the Ministry of Children and Family Development (MCFD). 

This pivotal decision mandated the release of previously redacted birth alert records to the privacy commissioner for a comprehensive review.


At the heart of this legal battle was a clash between families' rights to information that directly impacts them, and solicitor-client privilege, as outlined in Section 25 of the the Access to Information Act

This ruling was was a significant milestone in advancing transparency within our public institutions.


But, the Ministry of Children and Family Development is appealing the decision. On March 19, the Court of Appeal will convene to hear more arguments on this pivotal case. 



The Ministry of Children and Family Development's appeal of the Supreme Court's decision will determine whether Section 25 should be applied, or whether the Ministry must un-redact more of the documents in question. 


We are watching this case closely, and will update you when the new decision comes down.
